New Mexico Federal BLM & State Land Lease Workbook.
In Lea, Eddy, Chaves, and San Juan Counties, New Mexico, most sections combine federal BLM leases, New Mexico State Land Office (SLO) leases, and fee minerals. Learn how Record Title differs from Operating Rights and why county clerk records alone are never enough.
- Topic
- BLM Record Title vs. Operating Rights, NM SLO leases, and dual-record chains
- Statutes cited
- 43 CFR Part 3100; NMSA 1978 § 19-10-1 et seq.
- Cost
- Free self-study
Workbook checklist
- Pull the BLM MLRS serial register page and case file alongside the county clerk chain.
- Separate Record Title (the base lease as a whole or vertical aliquot part) from Operating Rights (severed by depth).
- Check New Mexico State Land Office (SLO) assignment approval stamps and lease prefix codes.
MethodRecord Title vs. Operating Rights
Key rules
- Distinguish Record Title from Operating Rights on federal BLM and NM State leases.
- Explain why depth-limited assignments transfer Operating Rights rather than Record Title.
- Reconcile County Clerk assignments against BLM and NM SLO agency approvals.
On fee land in Texas, a single County Clerk chain shows who owns the oil and gas lease. On federal and state lands in New Mexico, ownership is tracked in two parallel record systems: the federal Bureau of Land Management (BLM) or New Mexico State Land Office (SLO) agency files, and the County Clerk records in Lovington (Lea County) or Carlsbad (Eddy County).
- Record Title is the base lease contract. On a federal BLM oil and gas lease (43 CFR 3100.5), Record Title is the lessee's undivided interest in the lease contract itself across all depths as to all or a distinct geographic portion of the leased lands. A transfer of Record Title requires BLM approval on the official Record Title assignment form.
- Operating Rights (working interest) can be severed by depth. Whenever an assignment limits the transferred rights to specific formations or depth intervals (for example, "from the surface to the base of the Bone Spring formation" or "Wolfcamp formation only"), the transfer is a transfer of Operating Rights, not Record Title.
- Why county records and BLM/SLO files diverge. Operators frequently sign and record depth-specific partial assignments, wellbore assignments, and overriding royalty conveyances in the County Clerk's office that were never filed or approved on the BLM Record Title ledger, or where BLM approval lagged months behind the county filing.
- Communitization Agreements (CAs) and state/federal units. When a horizontal spacing unit combines federal, state, and fee tracts, a federal Communitization Agreement (or state/federal unit agreement) must be approved before production on one tract holds the other tracts in the spacing unit.
- Record Title
- The primary contractual leasehold interest recognized by the BLM or State Land Office across all depths of a lease or segregated geographic tract.
- Operating Rights
- The working-interest right to enter upon the leased lands to conduct drilling and production operations within specified depths or formations, carved out of Record Title.
- Serial Register Page
- The BLM case-record ledger listing the serial number (such as NMNM), effective date, royalty rate, Record Title holders, Operating Rights transfers, and communitization actions.
- Communitization Agreement (CA)
- An agreement approved by the BLM (and NM SLO where state lands are included) pooling federal, state, or fee leases within a state spacing unit so operations on any tract hold all communitized leases.

Worked ExampleDepth-severed BLM assignment problem
Other workbooks
Worked problem. Alpha Energy holds 100% Record Title and 100% Operating Rights in Federal Lease NMNM-012345 covering all of Section 10, T24S-R33E, Lea County, NM. Alpha executes and files an assignment transferring "100% of Assignor's right, title and interest in and to the Bone Spring formation only" to Beta Operating. After BLM approves the filing, who holds Record Title and who holds Operating Rights?
Record: Alpha 100% · Bone Spring: Beta 100%
Because a federal Record Title assignment cannot be severed horizontally by depth, Alpha remains the 100% Record Title holder of record, while Beta holds 100% of the Operating Rights in the Bone Spring formation and Alpha retains 100% of the Operating Rights in all shallower and deeper formations (including the Wolfcamp).
